Access to information

Within the framework of strengthening the principles of transparency and accountability, improving the management of public services, enhancing public participation in the formulation, monitoring and evaluation of public policies, and strengthening trust between bodies subject to the law, natural and legal persons, and civil society organizations, the Tunisian Constitution, in its Article 32, guarantees the right of access to information as a constitutional right ensured by the State. Furthermore, Organic Law No. 2016-22 dated March 24, 2016 relating to the right of access to information specifies implementation measures and related procedures.

Access to information is carried out either through proactive publication of information by the concerned body and access upon request in accordance with Articles 6, 7 and 8 of the Law, or through any natural or legal person submitting a written request for access to information according to a predefined model made available to the public (downloadable document).

The person in charge of access to information is responsible for receiving requests, processing them and responding within the specified deadlines.

An applicant who is not satisfied with the decision taken may submit an administrative appeal to the head of the concerned body within twenty (20) days from notification of the decision. The head of the body must respond as soon as possible, without exceeding ten (10) days from the date of submission of the review request.

Silence by the head of the concerned body during this period shall constitute implicit refusal. The applicant may submit a direct appeal to the Access to Information Authority.
